RULES FOR THE PURCHASE AND SALE OF GOODS IN THE ONLINE SHOP EGZOTIKA.LT  

These rules for the purchase and sale of goods in the online store Egzotika.lt (hereinafter - the Rules) set out the terms and conditions for the use of the online store Egzotika.lt (hereinafter - Egzotika.lt, Seller). The Terms and Conditions shall apply to the Buyer when purchasing goods and services in the online shop Egzotika.lt.

1.         GENERAL PROVISIONS

1.1. Egzotika.lt sale of goods and services is carried out by Lipeikis's company "Egzotika"; registered office address: J. Basanavičiaus g. 69B, Panevėžys; legal entity code: 168409136; VAT payer code: LT684091314.

1.2 The Buyer may purchase goods and services only after having read and agreed to all the provisions of the Terms and Conditions.

1.3. Egzotika.lt may be used by natural and legal persons of legal capacity.

1.4 The processing of the Buyer's personal data is described in the Privacy Policy, the current version of which is available on the Egzotika.lt website.

1.5 The Seller reserves the right to modify, process, amend and supplement the Terms and Conditions at any time, taking into account the statutory requirements or changes in other conditions.

1.6 The Buyer shall be obliged to familiarize with and agree to all the provisions of the current version of the Terms and Conditions each time he/she purchases goods and services. The current version of the Rules is available on the Egzotika.lt website.

1.7 The Purchase and Sale Contract shall be deemed to be concluded upon the Buyer's acquaintance with and acceptance of the Terms and Conditions, submission and payment of the order or selection of a different payment method or an advance invoice.

2.         RIGHTS AND OBLIGATIONS OF THE BUYER

2.1 The Buyer shall have the right to purchase goods and services on Egzotika.lt in accordance with these Terms and Conditions and in accordance with the procedures set out in the online shop.

2.2 By using the services of the online shop Egzotika.lt and purchasing goods and services, the Buyer agrees to these Terms and Conditions and must comply with them.

2.3 The Buyer is solely responsible for all his/her actions carried out using the Egzotika.lt website.

2.4 The Buyer must provide complete, clear, accurate and correct information requested when registering on the website and each time he/she submits, completes an order or purchases goods and services. In case of incomplete, unclear, inaccurate, incorrect data and after payment of the order or other payment method and confirmation of the order, the Buyer shall bear all the additional costs and damages resulting therefrom.

2.5 The Buyer shall be present at the delivery address specified in the order and shall accept the goods ordered at the time specified.

2.6 The Buyer undertakes not to pass on or allow anyone to use his/her login details. If you lose your login details, please notify [email protected] immediately. In the absence of notification, the Buyer shall be deemed to have carried out and be responsible for all actions taken after logging into the Buyer's account.

2.7 Egzotika.lt shall not be liable for contracts of sale concluded by third parties using the Buyer's login and/or billing data.

2.8. It is prohibited to register and use the Egzotika.lt website and online shop for the same person with different login data. If you lose your login details, please notify [email protected] immediately.

3.         RIGHTS AND OBLIGATIONS OF THE SELLER

3.1 The Seller shall make available and make accessible the online shop and the purchase of goods and services.

3.2 The Seller reserves the right to terminate the login account and its data without prior notice and to restrict the use of the website and the online shop Egzotika.lt.

3.3 The Seller reserves the right to cancel and block login accounts that are false, inaccurate, incomplete, not used, not used for their intended purpose, or that engage in unauthorised activities, intend to harm or violate these Terms and Conditions of Use.

3.4 The Seller undertakes to perform the Purchase and Sale Contracts, to notify the Buyer immediately if it is unable to perform the Contract due to circumstances that could not have been foreseen in advance, error, change of balance, supply disruption or other circumstances, and to offer an alternative option, if available. In the event of termination of the Contract, the amount paid shall be refunded to the Buyer within 5 working days ("w.d.").

3.5 The Seller reserves the right to cancel a completed order if the order cannot be fulfilled due to the Buyer's fault, e.g. not all or inaccurate data requested is provided, inaccurate or misleading delivery address is provided, or if the Buyer is unable to be contacted by telephone or e-mail.

3.6 The Seller reserves the right to unilaterally terminate the paid sales contract and refund the money paid to the Buyer within 10 days if the order cannot be fulfilled due to the Buyer's fault, e.g. not all or inaccurate requested data is provided, inaccurate or misleading delivery address is provided; no contact with the Buyer by phone or e-mail is possible. The Buyer shall be informed by e-mail of the termination.

4.         PAYMENT FOR GOODS AND SERVICES

4.1 The Buyer may pay for the goods and services by bank transfer or credit card.

4.2 Goods ordered and goods ordered by separate contract shall only be paid for by advance payment.

4.3 When making payment by bank transfer or on behalf of another person, it is necessary to specify the order code in the payment destination field. Failure to provide an order code may result in longer processing and delivery of the order.

5.         DELIVERY OF GOODS

5.1 Most goods in stock are delivered within 4-5 days. For all other goods, a delivery time is indicated, within which we can deliver the requested goods if they are in the supplier's warehouse. During the high season from 20 October to 20 November, delivery times may be longer due to supply disruptions, higher order volumes and other unforeseen circumstances.

5.2 For goods ordered by separate contract and enquiries, the indicative delivery time is indicated next to the specific goods, and in case of changes, the manager shall inform the customer prior to ordering the goods.

5.3 The price for delivery of the goods shall be indicated separately in the basket of goods after selection of the method of delivery.

5..      The Customer must inspect the Goods on receipt of the Goods - in the event of any error, damage or other discrepancy, the Customer must not accept the delivery. Upon acceptance of the Goods, the delivery shall be deemed to have been made in good order and without any defect. If the goods delivered do not correspond to the Buyer's order or if part of the consignment is missing, the Buyer must immediately inform the Seller by email to [email protected]

6.         RETURN OF GOODS

6.1. The Buyer of www.egzotika.lt shall have the right, within 14 (fourteen) days from the date of delivery of the goods to the Buyer, to reject the goods if they have not been assembled, used, damaged, or if their appearance has not been substantially altered, that is to say, the appearance of the goods has been changed only to such extent as is necessary for the purpose of inspecting the goods received.

6.2 The Buyer shall receive a full refund of the price paid for the returned goods. The costs of returning the goods to the Seller shall be borne by the Buyer.

6.3 The money paid by the Buyer shall be refunded no later than 10 days from the date of delivery of the goods returned by the Buyer to the Seller.

7.         WARRANTY OF GOODS

7.1 All our goods are warranted as to quality. This warranty is also known as a legal or factory warranty. The period of validity may vary: like other conditions, the period is indicated in the product description or on the invoice accompanying the product purchased, which is the same as the warranty card.

7.2 The warranty is for manufacturing defects. If the company's expert or, if necessary, a committee, finds that the tyre is mechanically damaged, has been operated with a rim of the wrong width or with a defective rim, or in the case of a defective car chassis, the claim shall be excluded. As a reminder, tyres must be balanced and their air pressure checked regularly.

7.3 Tyre mileage is not covered by warranty.

7.4 The warranty applies to the tyre not mounted on the rim.

7.5 The warranty takes effect from the date of sale of the tyres.

8.         DATE OF MANUFACTURE

8.1 The year of manufacture of the tyres offered in the Online Shop shall be indicated in brackets next to the tyre name. The year indicated is for information purposes only and minor inaccuracies are possible.

8.2 Where the year of manufacture of a product is indicated in a range next to the product name, we are unable to select a specific year of manufacture and will supply the product from the range of years of manufacture indicated in parentheses. If you wish to purchase a product with a specific year of manufacture, please select products with a specific year of manufacture.

9.         FINAL PROVISIONS

9.1 The electronic catalogue is not a specific commercial offer, prices and quantities are indicative and may vary due to errors, supply disruptions etc. In each individual case, the Managers will send a final quotation following a request from the Buyer.

9.2 Limited quantities of the Goods. If the stock is insufficient at the time of ordering, you will be contacted using the contact details you have provided.

9.3 The Seller reserves the right to change the prices of the Goods, the ordering, selling and promotional terms.

9.4 The photographs in the online catalogue are for information purposes only and minor inaccuracies may occur. The photographs are of a single tyre size. The tread pattern of tyres of different sizes may vary depending on tyre size, width and homologation of different manufacturers. The rims shown in the tyre pictures are for illustration purposes only and are not sold with the tyres. Tyre sidewall lettering, markings and lettering may not be the same as in the photographs, for specific details such as white lettering, please contact [email protected].

9.5 The product range and prices displayed on Egzotika.lt may not be the same as the product range and prices displayed in Egzotika tyre supermarkets. The prices of the online shop are valid only for online orders.

9.6 All disagreements and questions regarding the application and performance of these Terms and Conditions shall be settled in the first instance by negotiation between the Buyer and the Seller.

9.7 The Seller reserves the right to change the rules of the Egzotika.lt online shop without prior notice. The current version of the Rules is published on www.egzotika.lt.
